Effective date: October 31, 2026. These terms replace the version effective July 1, 2022.
These terms of service ("Terms of Service") are between you and AFSR 22 LLC d/b/a A Red Rose Realty ("A Red Rose Realty," "we," or "us"), a Texas real estate brokerage, Texas Real Estate Commission (TREC) license 9012614. They govern your access to and use of our website at www.A-Red-Rose-Realty.com, including its content, forms, and communication channels (the "Website").
By using the Website, you agree to these Terms of Service. If you do not agree, you must not use the Website. You must be at least 18 years old to use the Website.
We may change the Website and these Terms of Service at any time. Changes are effective when posted. Your continued use of the Website after a change is posted means you accept the change.
Information we collect on the Website is subject to our Privacy Notice, which is part of these Terms of Service. If the two conflict, these Terms of Service control. Please do not send confidential or personal information through the Website unless we specifically ask for it.
"A Red Rose Realty Team" means A Red Rose Realty, its owners, assigns, subsidiaries, affiliated companies, officers, directors, and the parties involved in creating, producing, or delivering the Website.
A Red Rose Realty offers home buying, home selling, and property management services. You can use the Website to learn about those services and to contact us.
Using the Website, submitting a form, or calling, texting, or emailing us does not by itself create an agency, listing, buyer representation, or property management relationship. Those relationships, and any fees for them, are set only by a separate written agreement. If a separate written agreement conflicts with these Terms of Service, the separate agreement controls.
Texas law requires brokers to provide two notices. You can read them here: Information About Brokerage Services and Consumer Protection Notice. Nothing in these Terms of Service limits your right to file a complaint with TREC.
Website content is current as of the date it is posted to the best of our knowledge. Property information, prices, availability, and market information can change without notice and may contain errors. Please verify anything important to your decision. Website content is general information. It is not legal, tax, financial, or inspection advice, and it does not guarantee any result.
If you check the consent box on one of our forms, you agree to receive SMS notifications, alerts, and occasional marketing communications from A Red Rose Realty at the number you provide. The Website and its content, including text, graphics, videos, logos, icons, images, and other material ("Website Content"), are the property of A Red Rose Realty or its licensors and are protected by copyright, trademark, and other intellectual property laws. Website Content does not include User Contributions, defined below.
The A Red Rose Realty and AFSR 22 LLC names and related logos are marks of AFSR 22 LLC ("Marks"). They may not be used without our advance written permission, including with any product or service that we do not provide, in any manner likely to cause confusion, or in any manner that disparages, discredits, or misrepresents us. Other names on the Website may be marks of their respective owners. Our Marks appearing on a third-party website do not imply our approval, sponsorship, or endorsement.
We grant you a personal, royalty-free, non-assignable, revocable, and non-exclusive license to view and use Website Content for your own real estate needs. Any other reproduction, modification, distribution, transmission, republication, framing, display, or performance of Website Content without our prior permission is prohibited. You may not remove any Marks or proprietary notices.
You may use the Website only for lawful purposes. You agree that you will not:
- Use the Website in any way that violates any applicable law or regulation, or to exploit or harm anyone.
- Submit false information or send unlawful advertising, promotional material, or spam through the Website.
- Impersonate A Red Rose Realty, our licensees or employees, or any other person or entity.
- Use any robot, spider, or other automatic or manual means to monitor or copy the Website without our prior written consent, except as needed for ordinary search engine indexing.
- Introduce viruses or other malicious or technologically harmful material.
- Attempt to gain unauthorized access to, interfere with, damage, overburden, or disrupt the Website or any connected server, system, or network, including by a denial-of-service attack.
"User Contributions" means messages, form entries, and other information you send through the Website. You are responsible for your User Contributions and represent that you have the right to send them. You grant us, the A Red Rose Realty Team, and our service providers the right to use them to respond to you and as permitted by these Terms of Service and our Privacy Notice.
You agree not to submit anything that is unlawful, threatening, abusive, harassing, defamatory, deceptive, or fraudulent; that invades another person's privacy; that victimizes, harasses, degrades, or intimidates anyone on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; or that infringes any party's proprietary rights. We may remove or decline to publish any material at our discretion.

To be effective, your written notice must contain: (a) an electronic or physical signature of the person authorized to act for the owner of the copyright or other intellectual property interest; (b) a description of the work claimed to be infringed; (c) a description of where the material is located on the Website, with enough detail for us to find it; (d) your address, telephone number, and email address; (e) a statement that you have a good faith belief that the disputed use is not authorized by the owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner.
The Website may include content provided by third parties and links to other websites for your convenience. Third-party statements and opinions are the responsibility of the party providing them and do not necessarily reflect our opinion. We do not control linked websites and are not responsible for their content, function, or terms, or for any loss or damage from your use of them. A link does not imply our endorsement. This section applies to your use of the Website. Any real estate services we provide you are governed by your separate written agreement with us.
Your exclusive remedy and our entire liability, if any, for any claims arising out of these Terms of Service and your use of the Website shall be limited to the amount you paid us through the Website during the three (3) month period before the act giving rise to the liability.
IN NO EVENT SHALL A RED ROSE REALTY BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM MALICIOUS CODE, LOSS OF USE, DATA OR PROFIT LOSS, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE WEBSITE OR OF ANY WEBSITE REFERENCED OR LINKED TO FROM THE WEBSITE.

You agree to defend, indemnify, and hold harmless A Red Rose Realty and the A Red Rose Realty Team against all demands, claims, actions, proceedings, damages, liabilities, losses, fees, costs, or expenses (including reasonable attorneys' fees and the costs of any investigation) directly or indirectly arising from or connected with your use of the Website ("Claims"), including: (a) our use of or reliance on information you supply; (b) any breach of these Terms of Service by you; (c) your negligence, gross negligence, or willful misconduct; (d) your misrepresentations; and (e) your violation of applicable law.
ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE, THE PRIVACY NOTICE, OR THE WEBSITE MUST BE COMMENCED WITHIN THREE (3) MONTHS AFTER THE EVENT GIVING RISE TO THE ACTION OR CLAIM OCCURRED, REGARDLESS OF WHEN YOU KNEW OR SHOULD HAVE KNOWN ABOUT IT; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
You agree that a breach of these Terms of Service will cause irreparable injury to A Red Rose Realty for which monetary damages would not be an adequate remedy and A Red Rose Realty shall be entitled to seek equitable relief, in addition to any remedies it may have hereunder or at law, without having to post a bond or other security.
No waiver by A Red Rose Realty of a term or condition set forth in these Terms of Service shall be deemed a continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of A Red Rose Realty to assert a right or provision under these Terms of Service shall not constitute a waiver of such right or provision.
If any provision of these Terms of Service is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.
Except as noted in Section 2, these Terms of Service and our Privacy Notice are the sole and entire agreement between you and A Red Rose Realty with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Website.
These Terms of Service remain in effect while you use the Website. Provisions that by their nature are intended to survive, including Sections 5, 7, and 10 through 19 and the Privacy Notice, remain binding after you stop using it.
We may, in our sole discretion, suspend or terminate your access to the Website (or any part of it) for any reason, with or without notice, and without liability to you or any third party. Suspected fraudulent, abusive, or illegal activity may be grounds for barring your access and reporting you to the proper authorities, if necessary.
PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY REQUIRE YOU TO AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION.
The laws of the State of TX will govern these Terms of Service and any disputes under them, without giving effect to any principles of conflicts of laws.
Any controversy or claim arising out of or relating to these Terms of Service shall be exclusively settled by arbitration administered by the American Arbitration Association in accordance with Commercial Arbitration Rules, then in effect. This arbitration provision is governed by the Federal Arbitration Act. The arbitration proceedings shall be held in San Antonio, TX. Any arbitration award may be entered in a court of competent jurisdiction.
All claims and disputes within the scope of this arbitration agreement must be arbitrated or litigated on an individual basis and not on a class basis. Claims of more than one customer or user cannot be arbitrated or litigated jointly or consolidated with those of any other customer or user.
a. Use Outside the United States. We make no representation that materials on the Website are appropriate or available for use outside the United States. Those who access the Website from other locations do so on their own initiative and at their own risk and are responsible for compliance with local laws.
b. Force Majeure. In addition to any excuse provided by applicable law, we are excused from liability for delay or non-performance relating to the Website arising from any event beyond our reasonable control, whether or not foreseeable, including labor disturbance, war, fire, accident, adverse weather, and governmental act or regulation.
c. Notices. Notices to us under these Terms of Service must be in writing and sent by email to the address in Section 19. We may send notices to you at any address you have provided to us. Notices are effective on receipt.
